Filing for bankruptcy ruins your credit for 10 years.
Not True. As with any other credit information, the fact of the bankruptcy can stay on your credit report for 7 to 10 years. (Remember, if you are considering bankruptcy it is highly likely that your credit rating has already been damaged, especially for the purpose of obtaining a home loan.) You can start rebuilding your credit, however, even before your bankruptcy is completed. Continuing to make your house or car payment on time can help you reestablish a good credit rating, as can making timely payments on a Chapter 13 plan or on any new loans.
Everyone will know you filed for bankruptcy.

After the recent changes to the bankruptcy law, filing bankruptcy doesn’t help much.
Not True. The 2005 changes mean that a few people may no longer be able to file a Chapter 7 case, but most people are still able to get the same relief now as before the law changed. If a Chapter 7 is not available to you because of the 2005 changes, Chapter 13 may still offer you significant relief.

The best things to do are to find some collateral to put up, because most likely, the loan you receive will be a secured loan. Another thing to do is to pay your bills on time and use a credit card responsibly, also paying it regularly. Do not buy things you cannot afford. When somebody says they’re going to file for bankruptcy it sounds easy right? Well, in order to file for bankruptcy there are some steps that need to be followed. There are 3 changes that now affect people before filing and they are the ticket in, the means test, and the ticket out.
Ticket In – If you want to file then you need to go to a credit counseling session. You need to attend this credit counseling sessions six months before you apply to file for bankruptcy. Also, your session cannot be done by just anyone. They need to be approved by the United States Trustees office.
Means Test – This is a test that is required under the new law. Your income is tested using a two part means test. This is a formula to determine if you’re going to be able to afford 25% of your unsecured debt. Unsecured debt is things like credit card debt. From there they will determine how your income looks compared to the states average. Depending on what your income looks like compared to the state average will determine if your able to file for Chapter 7 bankruptcy.

But use the law properly in your credit repair and you will move mountains.
Expect Resistance
The credit bureaus are governed by the Fair Credit Reporting Act (FCRA). It is both their gospel and a millstone around their neck. Most of the effective credit repair techniques that you will employ will utilize the routines and procedures mandated for the bureaus by the FCRA. And although the bureaus generally will comply they will not enjoy it and they may even resist. Your efforts must be made with an insight into the procedures that the bureaus have put into place in order to cooperate with the FCRA as well as their passive-aggressive techniques of resistance.
Section 611
The most relevant part of the FCRA to your credit repair project is Section 611. This outlines the responsibilities of any national credit bureau, including Experian, Equifax, and TransUnion, to process consumer disputes of the accuracy of information appearing on their credit reports. In brief, the credit bureaus must complete the processing of your dispute within 30 days of receiving the dispute. Within that 30 day period is included 5 days in which the credit bureau must notify the furnisher of the disputed information.
