When somebody says they’re going to file for bankruptcy it sounds easy right? Well, in order to file for bankruptcy there are some steps that need to be followed. There are 3 changes that now affect people before filing and they are the ticket in, the means test, and the ticket out.
Ticket In – If you want to file then you need to go to a credit counseling session. You need to attend this credit counseling sessions six months before you apply to file for bankruptcy. Also, your session cannot be done by just anyone. They need to be approved by the United States Trustees office.
Means Test – This is a test that is required under the new law. Your income is tested using a two part means test. This is a formula to determine if you’re going to be able to afford 25% of your unsecured debt. Unsecured debt is things like credit card debt. From there they will determine how your income looks compared to the states average. Depending on what your income looks like compared to the state average will determine if your able to file for Chapter 7 bankruptcy.

What can credit card debt consolidation services do for you? If you are stressing out over debt, these nonprofit organizations are great place to turn for help. They can be found in brick and mortar establishments in most communities and are readily available on the internet and give you information in a matter of minutes.
So, what can a credit counseling service do for you? The most important thing they do is consolidate all you unsecured debt into one monthly payment. Your payment will be about 2% of the total debt that you enroll into the debt management plan. It will be snowballed, which means your payment will remain the same throughout the repayment period even though your debt is decreasing.
Your interest rates will be decreased to about 10% and your fees will be eliminated. With all this combined, you will be looking at debt freedom in about five years. This is about half the time it would take you to pay off your credit cards by making minimum payments. One of the positive aspects of credit counseling is your credit will remain intact. So who needs credit counseling? Anybody whose debt loads are running high and who are thinking of filing bankruptcy, need counseling with their finances. Counseling services are meant to negotiate with your creditor for lower payments. More and more counseling on credit services are seen as they are encouraged by the payment system that is called the ‘fair share’.
If you are able to handle your finances well and pay your bills in time you are one amongst those who don’t need counseling. But if you see your bills mounting and you are panic stricken with too much debt to handle, you can seek help from a debt counselor. There are tell-tale signs to understand when you need counseling. They are:
• When all that you think you can afford to pay is the minimums on your credit.
• You have been late with your payments on one or more of your bills.

Certain amendments have been made in Bankruptcy laws in the US. The new laws prevent deceitful people from exploiting the system and thwarts citizens from filing bankruptcy without seeking out other options.
Changes In Chapter 7
Under the new Bankruptcy laws, it’d now be tougher to file for bankruptcy. Besides, certain filers that come in high-income class cannot use Chapter 7 bankruptcy any more. Instead, they would be required to repay a small amount of their debt under Chapter 13.
According to the new laws, debtors need to obtain credit counseling first and then file for bankruptcy. Even if you know that it’s not feasible to come up with a repayment plan or you don’t want to repay due to some unfair practice, you would still need to undergo counseling. In case the counselor formulates a repayment plan, you need to get a certificate proving that you have finished with the counseling and would have to submit both the certificate and the plan to the court. Is consumer credit counseling excellent? That greatly depends on an individuals particular circumstances.
